Privacy policy

In accordance with Regulation (EU) 2016/679 (GDPR) and Spanish Organic Law 3/2018 (LOPDGDD), we inform you about how we process the personal data you provide via this website and our contact channels.

Data controller

What data do we collect and why?

Through the contact form on the website we collect the data you yourself provide: name, email address, phone (optional), type of enquiry and message. We use it to answer your enquiry, send you information about our services when you request it and, if you contract any of them, to manage the contractual relationship.

If you take out a pass or any other service, we will additionally collect the data required for invoicing (full name, ID number, address, vehicle number plate, bank details in case of direct debit).

Legal basis for processing

  • Consent of the data subject, given by submitting the form or by contacting us through any other means.
  • Performance of a contract to which the data subject is party, when a service is contracted.
  • Compliance with legal obligations to which we are subject (tax, accounting, commercial).

How long do we keep the data?

Data from informal enquiries is kept for as long as needed to attend to them and for up to six months after, unless you decide to stay in contact with us. Data from customers with a contract is kept for the duration of the relationship and, afterwards, for the legally required periods (usually up to 6 years for tax and commercial obligations).

Who do we share your data with?

We do not share your data with third parties except when necessary by legal obligation (for example, the Spanish tax authority) or in order to provide you with the service (for example, our bank for payment processing).

We use third-party services to run the website and the contact form (email provider, form submission service, map services). Some of these providers may be located outside the European Economic Area; in that case, we ensure they offer guarantees equivalent to the GDPR.

Your rights

You can exercise the following rights at any time:

  • Access — to know what data of yours we process.
  • Rectification — to correct inaccurate data.
  • Erasure — to ask us to delete your data (subject to legal exceptions).
  • Objection — to us processing your data in certain cases.
  • Restriction — to ask us to restrict processing.
  • Portability — to receive your data in a reusable format.

To exercise these rights, write to us at at.cliente@centralparkcastelldefels.com stating the right you wish to exercise and attaching a copy of your ID or an equivalent identifying document.

If you consider that we have not handled your request properly, you have the right to lodge a complaint with the Spanish Data Protection Agency (www.aepd.es). If you are a resident of Catalonia, you can also lodge it with the Catalan Data Protection Authority (apdcat.gencat.cat).

Car park rules

General rules of use and operation for the garage-car park. Use of the car park, whether with a vehicle or on foot, implies acceptance of these rules.

Legal framework: this car park regulates its commercial activity in accordance with Spanish Law 40/2002, of 14 November, governing the vehicle parking contract, and with the terms and conditions contained in these General Rules.

General rules

Parking bay

In this car park, vehicles under a fixed daily or monthly pass will have a bay, either fixed or variable. Other vehicles may park — unless otherwise indicated because the car park is full — always within the limits of a single bay marked as such and not reserved, or occasionally in a spot indicated by a member of staff.

The use of more than one bay by a single vehicle will be charged at the price of two bays.

Ticket

The user will take, or be given, the ticket at the entrance or, where applicable, will enter using the pass-holder's card. The ticket must never be left inside the vehicle.

Signage

Pass holders and customers in general shall follow the entry, control and exit signage in place. Users must respect the signs and, where applicable, the instructions of staff, which shall always prevail over any existing signage.

Vehicle circulation and pedestrians

  • Pedestrians have priority and shall only use vehicle ramps when, exceptionally, these are signposted.
  • Vehicles shall be driven at a moderate speed, up to a maximum of 10 km/h.
  • When starting the engine or leaving a bay, the engine shall not be warmed up in the bay but while driving.
  • Vehicles shall only be kept with the engine running while driving or during entry or exit manoeuvres from the bay. Never while parked.

Purpose of the parking contract

By parking your vehicle in a bay of this garage, you expressly accept entering into a parking contract whose sole purpose is the parking of your vehicle for a period of time, in exchange for a price.

In accordance with the above, it is strictly forbidden to use the bay for any purpose other than parking the vehicle, or to occupy or use the vehicle for any purpose while it is parked. Specifically, the following is forbidden:

  • Remaining on the premises longer than necessary for the normal use of the service.
  • Carrying out repair or cleaning work.
  • Moving or handling other customers' vehicles.
  • Leaving on the premises, inside or outside vehicles, any materials, dangerous objects or animals.
  • Holding meetings, sales, collections, handing out advertising leaflets to other users or leaving them on vehicles.
  • Smoking in the car park, creating flames or handling electronic devices.

Recommendations

  • Lock vehicles parked in marked bays, leaving them parked and with the handbrake on. Close the windows and, if possible, disconnect the battery.
  • Do not leave valuables in the vehicle.
  • Do not drive in neutral.
  • Drive with the vehicle's lights on.
  • Give priority to vehicles carrying out parking manoeuvres.

Liability

  • The operator of the car park shall only be liable for damages that the vehicle and its fixed accessories may suffer while parked in a bay of the car park, and provided such damages are legally attributable to the company or its staff.
  • This establishment does not provide a special custody service for non-fixed and removable accessories of the vehicle.
  • The user will be liable, before the operator and other users, for damages caused by failure to comply with their duties or by lack of skill in driving the vehicle within the garage or car park premises (art. 5.2 of Spanish Law 40/2002).

Breakdown

In the event of a breakdown, the user will contact the staff and follow their instructions. In general, for any question or eventuality, the user will approach the staff of the garage-car park.

Specific rules for pass holders

Monthly pass holders

The formalisation of the contract between the company and the user may be verbal or written. The parties will freely agree on the terms of the contract according to the company's options and the customer's needs: 24-hour pass, daytime only, night-time only, weekends, etc.

The monthly pass contract, whether verbal or written, will always be formalised for a duration of one month, being tacitly renewed for another similar period at the end of each month until either party freely decides to terminate it, by sending the other party a formal notice fifteen days in advance.

The monthly pass fee must be paid in advance, between the 1st and 5th of each month, in the manner agreed with the company.

Late payment. Monthly passes not paid by the due date will incur a surcharge of 5% in the first month of delay and 10% at the end of the second. From the third month, and as a precautionary measure, the vehicle will be immobilised to secure the debt, pursuant to article 5.3 of Spanish Law 40/2002 governing the vehicle parking contract.

When arranging the pass, the pass holder must pay in cash the fee for the first month and, additionally, a deposit upon delivery of the access card and key.

This garage-car park does not provide a special custody service for objects or accessories owned by customers, so they must remove them from their vehicles while these remain parked on the premises.

The monthly pass holder shall have a bay available at all times within the agreed opening hours.

Pass holders with fixed bay

If you have a fixed bay contracted, the bay will be available for the person who contracted it to park, exclusively — unless authorised by the person in charge of the garage-car park — the vehicle for which it was contracted. No motorcycle, bicycle or any other object such as trailers or other items may be parked there, except with express authorisation from the garage-car park.

If at any time you find your bay occupied for reasons unrelated to the garage's management, please approach the person in charge, who will tell you where to park temporarily until you can use your own bay.
